Several individuals have filed a lawsuit against Archuleta County, with that suit relating to localized flooding that occurred in 2013 and a previous culvert replacement that allegedly led to the flooding.
The complaint and jury demand was filed on June 30 and specifically names the Archuleta County Board of County Commissioners, Archuleta County Public Works Director Ken Feyen and “John Doe(s)” employed by Archuleta County.
The suit was filed by Gary Fletcher, Dixie Sandoval, Josephine Fletcher and Karla Wilson, with those plaintiffs represented by Shawn Davlin of Davlin & Davlin LLC, a Durango law firm.
The area in question in the lawsuit is Andrews Lane, located off of County Road 500 near Navajo Reservoir and Arboles.
When asked about the suit, Archuleta County Attorney Todd Starr said that, while he has read the complaint, the county had not been officially served as of Tuesday morning. He noted that the county would have 30 days to file a response after being served.
He declined to comment further on the suit or the allegations included in it.
The allegations
According to the complaint, the property in question is used to access other properties along Andrews Lane and is owned by Josephine Fletcher.
