TO: ALL PERSONS INTERESTED IN WATER APPLICATIONS IN SAID WATER DIVISION NO. 7
Pursuant to C.R.S. 37-92-302, you are notified that the following is a portion of all water right applications filed in the Office of the Water Clerk during the month of May 2024, for Archuleta County.
2024CW3013 Archuleta County, Colorado. APPLICATION FOR CONDITIONAL UNDERGROUND WATER RIGHT. Name and address of Applicant: Archuleta School District, c/o Rick Holt, Superintendent, 309 Lewis Street, P.O. Box 1498, Pagosa Springs, CO 81128. Drawer 2030, Glenwood Springs, CO 81602, (970) 945-2261. Name of structure: School Hot Water Well. Legal description: a point in the SE¼ of the NW¼ of Section 13, T35N, R2W, NMPM. UTM x 321756.1, UTM y 4126597.2, Latitude 37.268906, Longitude - 107.010281. Source: Groundwater tributary to the San Juan River. Appropriation date: January 1, 1979 (historic date: August 30, 1924). How appropriation was initiated: By completion of new school building where water was to be used. Amount: 0.75 c.f.s. (335 GPM), conditional. Uses: Heat school buildings (commercial). Depth: Approximately 350 feet. Remarks: The School Hot Water Well was originally decreed on July 28, 1980. Diligence was not maintained on the water right and as a result the original right was deemed abandoned on April 1, 1996. The well is artisan in nature and while capped, it leaks a sufficient amount to cause damage to the surrounding property. Applicant intends to rehabilitate the well for the uses identified above. THE WATER RIGHTS CLAIMED BY THE FOREGOING APPLICATION(S) MAY AFFECT IN PRIORITY ANY WATER RIGHTS CLAIMED OR HERETOFORE ADJUDICATED WITHIN THIS DIVISION AND OWNERS OF AFFECTED RIGHTS MUST APPEAR TO OBJECT AND PROTEST WITHIN THE TIME PROVIDED BY STATUTE, OR BE FOREVER BARRED.
YOU ARE HEREBY NOTIFIED THAT YOU HAVE until the last day of July 2024, to file with the Water Clerk, a verified Statement of Opposition, setting forth facts as to why a certain application should not be granted or why it should be granted only in part or on certain conditions. A copy of such Statement of Opposition must also be served upon the applicant or the applicant’s attorney and an affidavit or certificate of such service shall be filed with the Water Clerk, as prescribed by Rule 5, CRCP.
