Walmart appeals determination on parking lot lights

The Pagosa Springs Board of Adjustments will conduct a public hearing next Tuesday, June 30, to consider an appeal from Walmart Real Estate Business Trust regarding Town Planner James Dickhoff’s determination that the exterior parking lot lighting at the new store on Aspen Village Drive violates the town’s Land Use and Development Code.

Dickhoff agreed that his initial ruling and Walmart’s response are public documents, and he provided copies to SUN staff yesterday morning so the public could be aware of the details of the issue.

However, he reiterated that while next Tuesday’s hearing is open to the public and people are encouraged to come witness the proceedings, the board will not be accepting public comment at that time. This will be more like a court procedure, where each side will present its arguments and the board will make a ruling.
