BoCC dismisses lawsuit, owner and PLPOA continue legal battle

The Archuleta County Board of County Commissioners has decided to dismiss a nuisance ordinance lawsuit against a resident levied by the county in light of a lawsuit filed by the same property owner against the Pagosa Lakes Property Owners Association (PLPOA).

The suit, against a homeowner accused of improperly using a residential home commercially, was originally filed in May 2012, was later dismissed in September 2012 by the county due to concerns over the effectiveness of legal procedures taken, and was refiled in its current form shortly thereafter.
