A complaint has been filed in district court by a local resident against the Archuleta County Clerk and Recorder regarding an executive session recording that took place Sept. 22.
The complaint, filed by plaintiff Greg Giehl and his attorney, Matthew Roane, was filed against defendant June Madrid pursuant to the Colorado Open Records Act (CORA).
Madrid serves as Archuleta County’s clerk and recorder, which also makes her the custodian of records for the Archuleta County Board of County Commissioners (BoCC).
The complaint, filed by Giehl on Dec. 15, states that after the BoCC learned of Archuleta County Attorney Todd Starr’s resignation, the BoCC scheduled a special meeting for the following day, which was Sept. 22.
“However, the BoCC never posted public notice of the Special Meeting prior to convening the Special Meeting,” states the complaint.
The complaint goes on to state that, if the BoCC did post public notice of the meeting, they did so after the special meeting already occurred.
The agenda for the special meeting included an executive session.
According to the complaint, the only purpose for the executive session was identified as personnel matters, with the presenter of the executive session being Starr.
The complaint goes on to state that between Sept. 23 and Oct. 5, the BoCC never convened any type of meeting to discuss a possible contract with Starr, and also never advertised an opening for the county attorney position, nor attempted to obtain any competing bids from other attorneys.
