At the Dec. 10 special meeting of the Pagosa Area Water and Sanitation District (PAWSD) board of directors, the board voted unanimously to not fund the line items in the budget associated with the operation and maintenance of the pipeline related to the Intergovernmental Agreement (IGA) between The Town of Pagosa Springs Sanitation General Improvement District (PSSGID) and PAWSD.
The two parties entered into the agreement in 2012 to provide wastewater treatment services to the PSSGID.
The IGA calls for both entities to budget the funds each year to run the project. Budgets statutorily have to be approved by Dec. 15.
According to the agreement, the IGA may be terminated by failure “to appropriate moneys for the ensuing fiscal year to pay all amounts estimated to become due” under the IGA.
During recent months, the PSSGID board and the PAWSD board have held separate executive sessions relating to the IGA.
Last Thursday’s PAWSDmeeting was slated for executive session to discuss the IGA, however, PAWSD board opted out of an executive session and discussed the challenges the two boards were having in negotiating terms of the IGA in open session.
“We are having decision-making paralysis between the two groups,” said PAWSD Board Chairman Mike Church.
