As a result the headgate for the Vic Johnson Ditch has changed. Applicants seek a change in point of diversion for the Vic Johnson Ditch water right so that said water right can be protected by the terms of a decree. The use and place of use for the Vic Johnson Ditch water right will remain as intended at the time the Vic Johnson Ditch was decreed. Applicants do not seek to requantify or change the original irrigated lands served by the Vic Johnson Ditch water right. The irrigated lands described in the original decree have been partially removed by the 1936 and 1971 US Highway 160 construction work. Applicants request that this changed point of diversion be adjudicated pursuant to the legal standards for a simple change in surface point of diversion. See C.R.S. §37-92-305(305).
