PRIMARY ELECTION NOTICE

FOR ARCHULETA COUNTY, COLORADO

To the Electors of Archuleta County, Colorado, in accordance with the provisions of Colorado Revised Statutes, Section 1-7.5-107(4.3)(b), a Colorado Election will be held in several precincts in the State, on Tuesday, the 26th day of June, 2012. The lawful polling place designated for all precincts will be the Election’s Office. It will be open Election Day from 7:00 a.m. to 7:00 p.m.

Archuleta County will be utilizing a Mail Ballot Election for the June 26, 2012 Primary Election. All ballots will be mailed to voters who have an “Active” or “Inactive-Failed to Vote” status at the time of mailing. The ballots are currently projected to be mailed out June 4, 2012.

You may drop-off your voted Mail Ballots in the County Clerk’s Office upstairs in the Motor Vehicle Office or downstairs in the Election’s Office. Office hours for both of those offices are 8:00 a.m. to 4:00 p.m. Monday through Friday (except legal holidays). The Election’s Office will be the only office open between 7:00 a.m. 7:00 p.m. on June 26, 2012, Election Day.

There will be no Early Voting. If you are Unaffiliated, you may walk into the Election’s Office, affiliate with a major party and receive a ballot. You may do this even on Election Day. You may not change your party (Democrat to Republican etc.) and you must bring ID with you. You will also be able to replace your ballot if you have lost, spoiled, or did not received it. Ballots returned for incorrect addresses, once received by our office, may be picked up if ID is shown. The Election’s Office will also be open from 8:00 a.m. to 4:00 p.m. June 23, 2012 which is the Saturday prior to the Primary Election for dropping off ballots.

The following are the official nominations that will be voted on at the Archuleta County, June 26, 2012 Primary Election.

Note: There will be four ballots, a Democratic, a Republican, an American Constitution and a Libertarian.

OPPORTUNITY TO COMMENT

Williams Creek Campground Hazard

Tree Removal Project

San Juan National Forest

Pagosa Ranger District

Hinsdale County, Colorado

The Pagosa Ranger District is preparing a Decision Memo for the Williams Creek Campground Hazard Tree Removal project. The project will cut and remove trees within the campground area that are infected with various forms of disease. The trees will be sold as either firewood or sawtimber. A description of the proposed action and other information regarding this action is available for review at the Pagosa Ranger District Office at 180 Pagosa Street in Pagosa Springs, Colorado. Information can also be downloaded from the San Juan National Forest projects web site at: www.fs.usda.gov/goto/sanjuan/projects .

This comment period coincides with public scoping and will be the only comment opportunity offered on this project (see 36 CFR 215.5 and 215.6). It is intended to provide those interested in or affected by this proposal an opportunity to make their concerns known before the Responsible Official makes a decision. In light of a recent court ruling (Sequoia ForestKeeper v. Tidwell, 11-cv-00679-LJO-DLB (E.D. Cal.)), the Forest Service will provide public notice, comment, and opportunity for administrative appeal for projects and activities documented with a “Decision Memo” (36 CFR 220.6(e)) until new instructions are issued by the Washington Office, or the Agency issues regulations addressing the Court’s ruling. In addition, the Forest Service will prepare Decision Memos and offer notice, comment and appeal opportunities for timber sales and proposed approvals of oil or gas exploration and development activities that rely upon Section 390 of the Energy Policy Act of 2005. Only those who provide comment or express interest in this proposal during this comment period will be eligible to appeal the decision pursuant to 36 CFR part 215 regulations.

How to Comment and Timeframe

Written, facsimile, hand-delivered, oral, and electronic comments concerning this action will be accepted for 30 calendar days following the publication of this notice in the Durango Herald. The publication date of this notice is the exclusive means for calculating this comment period

To be eligible to appeal the subsequent decision on these projects, an individual or group must provide comment or otherwise express interest in the proposed actions during this comment period. Those individuals and organizations wishing to be eligible for appeal must provide the information as stated in 36 CFR 215.6 (3). Regulations prohibit extending the length of the comment period.

Written comments must be submitted to: District Ranger, PO Box 310, Pagosa Springs, CO 81147, or hand-delivered to the Pagosa District Office at 180 Pagosa Street in Pagosa Springs, Colorado between 8:00 am – 4:30 pm, Monday through Friday, excluding holidays. Electronic comments must be submitted in a format such as an email message, plain text (.txt), rich text format (.rtf), and Word (.doc) to comments-rocky-mountain-san-juan-pagosa@fs.fed.us. In cases where no identifiable name is attached to an electronic message, a verification of identity will be required for appeal eligibility. A scanned signature is one way to provide verification. For electronically mailed comments the sender should normally receive an automated acknowledgement from the agency as a confirmation of receipt. If the sender does not receive an automated acknowledgement receipt of comments, it is the senders responbility to insure timely receipt by other means (36 C.F.R. 215.6 (4) (iii)).

Comments received in response to this solicitation, including names and addresses of those who comment will be considered part of the public record on this proposed action and will be available for public inspection. Comments submitted anonymously will be accepted and considered; however, those who only submit anonymous comments will not have standing to appeal the subsequent decision under 36 CFR Part 215.14.

PUBLIC NOTICE

The Town Council of Pagosa Springs will conduct a public hearing on June 21, 2012 at 12 noon in Town Hall, located at 551 Hot Springs Blvd, regarding an application received requesting the Vacation of the Aspen Park Circle public right of way (ROW) and the associated public utility easements. Aspen Park Circle is located within the Aspen Village subdivision. The Town Council will consider the first reading of an Ordinance for the requested ROW vacation at this public hearing. Interested parties may provide public comments related to the ROW Vacation Application, as it relates to the Town’s Land Use Development Code, at the public hearing. Written comments in advance of the public hearing, related to the ROW Vacation Application as it relates to the Town’s Land Use Development Code, will be accepted until June 11, 2012 at the Town Planning Department. Anyone interested in more information should contact the Town Planning Department. The second reading of the ROW Vacation Ordinance may occur on July 3, 2012 at 5pm in Town Hall.
