2011 Asphalt Preservation Project
Archuleta County, Colorado is in the process of finalizing the above listed project constructed by Elam Construction, Inc., which included work on light Plant Road (CR 119), Pinon Causeway, Capricho Circle, South Pagosa Boulevard, Buttress Avenue, Meadows Drive, North Pagosa Boulevard, and Trujillo Road (CR 500). Any claims against this project by suppliers, subcontractors, or others should be delivered to the project engineering firm of Davis Engineering Services, Inc. at 188 S. 8th Street, P.O. Box 1208, Pagosa Springs, Colorado 81147. All claims shall be delivered prior to December 5, 2011. Any claims received on or after December 5, 2011 shall not be considered. Name of the structures for which an absolute water right is sought: Dodd’s Spring. 3. Legal description of points of diversion (see map Exhibit A – all exhibits to the application are available from the water court): Dodd’s Spring is an artesian spring which is an area of continually seeping and flowing ground that comprises much of the Northern ½ of the Dodd property, located in the W ½ of the NE ¼ of the NE ¼ of Section 31, Township 35 North, Range 2 East, of the New Mexico Principal Meridian in Archuleta County, Colorado. The spring has a diameter of approximately 400 feet with its midpoint being located approximately 325 feet south of the northern border of section 31, and 1035 feet west of the eastern border of said section 31. See Exhibit B (showing one of multiple trickling flows from the spring). The flow from the spring is collected into a single ditch which runs from the eastern boundary of the Dodd property southwest to a point approximately 90 feet east of the western border of the NE ¼ of the NE ¼ of section 31, which substantially coincides with the Dodd property’s western boundary. See map, attached as Exhibit A, which is incorporated herein by reference. 4. Source: Spring arising on the Applicant’s property. This spring is tributary to the Rio Blanco River, tributary to the San Juan River. 5. Date of appropriation: July 1, 2000. The appropriation for the water rights claimed herein was initiated when Mr. Dodd dug out and enhanced the natural channel collecting water from the spring, to control its flow, after he purchased the property in 2000. Mr. Dodd built culverts which direct the flow under the main road to the property and under Mr. Dodd’s driveway. He also improved the channel to direct the natural flow of the spring across his property. See Exhibit C. He has continually maintained this ditch since purchasing the property in 2000. Since the date of appropriation Mr. Dodd has diligently enhanced the ditch system by improving two existing lateral ditches, constructing a third (being the westernmost lateral) in 2005, and periodically removing silt build-up in the system. The lateral ditches are numbered 1-3 on the map attached hereto as Exhibit A. For each of the three ditches Mr. Dodd installed a headgate and various ‘overflow” gates to control the flow of the springs and allow irrigation of the southern portion of the Dodd property. See Exhibit D. The Northern section of the property is irrigated directly by the Dodd Spring, while the southern section is irrigated by the spring as conveyed through the ditch and laterals. The spring rights claimed in this application were made absolute on July 1, 2005; the entire Dodd parcel has been under continuous irrigation since that date. 6. Amount Claimed: 0.1 c.f.s. or 45 gallons per minute, ABSOLUTE. 7. Uses: Stock watering, domestic use and irrigation of approximately 9 acres of land in the W ½ of the NE ¼ of the NE ¼ of Section 31, Township 35 North, Range 2 East. See map attached as Exhibit A. 8. Remarks: The irrigated parcel comprises the entirety of the Dodd property shown by the black outline on Exhibit A, exclusive of the house, road, and driveway areas. The northern 2 acres of the property is irrigated directly from the spring, while the southern 7 acres is irrigated by means of the spring as conveyed through the ditches constructed, enhanced and maintained by Mr. Dodd. The entirety of this area has been under continuous irrigation since July 1, 2005. Mr. Dodd claims the right to confirm a greater or lesser amount as absolute without further notice or publication, based on his exercise of the spring rights from the date of their appropriation up to the time of any hearing in these proceedings. 9. Name and address of owners of land on which the structures are located: All structures included in this application are located on the Applicant’s property at the address described in ¶ 1. 10. Location Map: Exhibit A shows the location of Dodd’s Spring and Dodd’s ditches. Archuleta County, Colorado is in the process of finalizing the above listed project constructed by Elam Construction, Inc., which included work on light Plant Road (CR 119), Pinon Causeway, Capricho Circle, South Pagosa Boulevard, Buttress Avenue, Meadows Drive, North Pagosa Boulevard, and Trujillo Road (CR 500). Any claims against this project by suppliers, subcontractors, or others should be delivered to the project engineering firm of Davis Engineering Services, Inc. at 188 S. 8th Street, P.O. SHERIFF’S COMBINED NOTICE OF SALE, RIGHT TO CURE AND RIGHT TO REDEEM
TO WHOM IT MAY CONCERN:
This is to advise you that the above-captioned action is pending. A Judgment and Decree for Judicial Foreclosure has been entered in this action concerning an assessment lien by the plaintiff Ptarmigan Property Owners Association, Inc. pursuant to the Colorado Common Interest Ownership Act, Colorado Revised Statutes, §3-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Ptarmigan Property Owners Association, Inc. of (said) Assessment Lien being recorded on September 15, 2011 at Reception No. 21006283, in the office of the Clerk and Recorders Office of Archuleta County, Colorado (the “Assessment Lien”).
The real property which is the subject matter of this litigation, which is the property subject to the Assessment Lien, is situation in Archuleta County, and is described as follows, to-wit:
Unit Week Number 7229, Unit Number 15, Building Number 16, in “Ptarmigan Townhouses Phase V, as recorded under Reception No. 179510 subject to Declaration of Individual and/or Interval Ownership for Ptarmigan Townhouses recorded under Reception Number 153557 and amendments and supplements thereto in the Office of the County Clerk and Recorder in and for Archuleta County, Colorado.
The Plaintiff named above is the judgment creditor in this action and the lienor of the property pursuant to the Colorado Common Interest Ownership Act, Colorado revised Statutes, §33-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Ptarmigan Property Owners Association. As of September 15, 2011 the outstanding balance due and owing on such judgment is $2,600.00.
I shall offer for public sale to the highest bidder, for case, at public auction, all the right, title and interest of the defendants in said property on Jan. 11th, 2012 at 10:00 a.m. at the Archuleta County Sheriff’s Office, 449 San Juan St., Pagosa Springs, CO 81147.
