On or about July 20, 2011, counsel for LPAWD became aware that the caption of the Application in this matter did not contain Archuleta County, the location of the point of diversion claimed in this matter. Description of the Subject Water Rights from Prior Decrees: Original Decree issued on November 10, 2004, Case No. 03CW103, District Court, WD 7, Findings of Fact, Conclusions of Law and Decree, Concerning the Application for Water Rights of La Plata Archuleta Water District Task Force, in La Plata County, Colorado. 4. The location of the proposed diversion structure is as follows: The headgate of the proposed diversion structure will be located on the west bank of the Piedra River in the NW1/4 of the SE1/4 of Section 32, Township 33 North, Range 5 West, N.M.P.M., a distance of 1,700 feet from the South section line and 2,000 feet from the East section line; at UTM Coordinate 285405 Easting, 4104081 Northing, in Zone 13S (NAD83 format); near Navajo Reservoir in Archuleta County, Colorado. 5.0 cfs, CONDITIONAL. Source: Piedra River. Diversions may be made using a surface diversion and/or a subsurface collection system. Appropriation Date: September 30, 2003. Uses: (1) All uses associated with a rural water system, including but not limited to domestic, commercial, industrial, municipal, lawns and gardens, orchards, livestock, fire flow, recreation, fishery, and evaporation, but not augmentation or exchange; (2) Storage at the location of the future District’s treatment plants to facilitate the water treatment process, principally for the settlement of the raw water for the uses listed above from the surface/subsurface diversions; and (3) Treated water exchange with other water providers pursuant to Colorado law. Carriage: Under arrangements allowed by Colorado water law, Applicant may divert, at the location described above, water from upstream water rights. 5. Outline of the work done during the diligence period for completion, or toward completion, of the appropriation and application of water for a beneficial use as conditionally decreed, including expenditures: La Plata Archuleta Water District Task Force, and the La Plata Archuleta Water District once organized, incurred expenses in excess of $500,000.00 for the organization, development and acquisition of funds for operation of the District including the following specific activities: (a) The District’s Service Plan was approved by Resolution No. 2007-41 of the Board of County Commissioners for La Plata County on October 16, 2007. Thereafter, the District participated in extensive litigation with oil and gas companies to concerning exclusions of certain properties and procedural matters; (b) Following conclusion of the exclusion litigation, the District organizational election was held on August 12, 2008 with the majority of electors approving the formation of the District. On August 19, 2008, the La Plata County District Court issued its Findings, Order and Decree, which officially established the District; (c) The water rights that are the subject of this case were originally appropriated and decreed in the name of the La Plata Archuleta Water District Task Force. By water rights quit claim deed dated December 29, 2008, the La Plata Archuleta Water District Task Force transferred its water rights to the District. Subsequently, the District filed with this Court its Notice of Transfer of Conditional Water Right on June 3, 2009; (d) Throughout 2009, the District developed a Master Plan, dated November 2009, and distributed the Master Plan to governmental agencies with facilities and land interests in or near the District’s service area. The Master Plan addresses the District’s future water demands, evaluation of the Subject Water Rights, alternative and preferred water sources, water treatment requirements, hydraulic analyses of the pipeline distribution systems and preliminary routing of pipelines, cost estimates of pipelines and facilities, District financing opportunities, steps for construction, and agency and public involvement in the planning and development of facilities. The Master Plan was funded by grants obtained from the Southwestern Water Conservation District, the Colorado Water Conservation Board through the Water Supply Reserve Account and the Colorado Department of Public Health and Environment; (e) On May 2, 2010, the District held an election seeking approval of a 5.000 mill levy against property within the District. The mill levy was approved. The revenues resulting from such property taxation will first be received by the District in fiscal year 2011; (f) During the period spanning August through November of 2010, the District has actively recruited District Manager candidates, with the intent to hire its first Manager as soon as practicable. 6. Compliance with Original Decree: As required by paragraph 9.A of the Original Decree, the subject water rights are owned as of the date of this application for findings of reasonable diligence by the La Plata Archuleta Water District, a Title 32 Special District (see paragraphs 4. (a) – (c) hereinabove). 7. The gallery well was installed between August 2003 and September 2005, together with the hauling station, pump house, etc., at a total cost of $74,000. BAYFIELD SCHOOL DISTRICT 10 Jt-R

LA PLATA COUNTY, COLORADO

The Board of Education of Bayfield School District 10 Jt-R in the County of La Plata, State of Colorado, calls for nomination of candidates for school directors to be placed on the ballot for the regular biennial school election to be held of Tuesday, November 1, 2011.

At this election three (3) directors will be elected for four (4) year terms, and one director will be elected for a two (2) year term. To be qualified, a candidate must have been a registered elector of the school district for at least twelve consecutive months before the election. A person is ineligible to run for school director if he or she has been convicted of committing a sexual offense against a child.

A person who desires to be a candidate for school director shall file a written notice of intention to be a candidate and a nomination petition which requires fifty (50) valid signatures in accordance with law.

Nomination petitions may be obtained at the Bayfield School District Administration Office, 24 Clover, Bayfield, Colorado, 81122. Office hours are 7:30 a.m. to 4:30 p.m..

Completed petitions should be submitted to the La Plata County County Clerk and Recorder (Elections) Office, 98 Everett Street, Suite C, Durango, Colorado 81303, no later than 4:30 p.m. on Friday, August 26, 2011.

PUBLIC NOTICE REQUEST FOR PROPOSALS The Town of Pagosa Springs, Colorado (the “Town”) is soliciting Proposals for the Construction of a new Restroom Facility for Yamaguchi Park, located off of 5th Street south of Apache. Sealed proposals for furnishing the following to the Town of Pagosa Springs, Colorado will be received at the Pagosa Town Hall Conference Room, first floor, 551 Hot Springs Blvd. on August 18, 2011at 2pm, proposals will be opened and read aloud. Proposals received after 2pm on August 18, 2011 will be returned unopened. BID ITEM: Provide labor and materials for the construction of a new building housing men’s and women’s restroom facilities, plus a storage room and mechanical room. The structure is approximately 22’ x 30’, and consists of concrete masonry unit walls, framed walls, and a framed pitched roof. Associated site work includes site utilities and paving. Proposals shall be submitted in writing and signed by the bidder or his duly authorized agent. Proposals shall be submitted in sealed envelopes, and marked on the outside with “PROPOSAL: RESTROOM FACILITY YAMAGUCHI PARK RFP”, and with the bidder’s name.
