The second reading of Ordinance No. 762 (Series 2011) was completed at the Pagosa Springs Town Council Meeting held on July 5, 2011 at 5:00 p.m. in the Council Chambers at the Town Hall. ORDINANCE NO. 762 (SERIES 2011), AN ORDINANCE SUSPENDING THE PROCESSING OF APPLICATIONS FOR MEDICAL MARIJUANA CENTERS, MEDICAL MARIJUANA OPTIONAL PREMISES CULTIVATION OPERATIONS AND MEDICAL MARIJUANA INFUSED PRODUCT MANUFACTURING BUSINESSES AND SUSPENDING THE DELIVERY OF SUCH MEDICAL MARIJUANA BUSINESS PRODUCTS FROM OUTSIDE OF ARCHULETA COUNTY UNTIL SEPTEMBER 01, 2012. Sealed bids will be received by the Pagosa Area Water and Sanitation District (District), 100 Lyn Avenue, P.O. Box 4610, Pagosa Springs, Colorado 81147, until 10:00 a.m. on July 22, 2011. Bids received after this time will not be accepted and will be returned unopened.

At 10:00 a.m. on Friday July 22, 2011, the bid opening shall be held at the District Conference Room at 100 Lyn Avenue, Pagosa Springs, Colorado; all Bids that have been duly received will be opened publicly and read aloud. All interested parties are invited to attend. The District reserves the right to reject any or all Bids and to waive irregularities therein, and all Bidders shall agree that such rejection shall be without liability on the part of the District for any damage or claim brought by any Bidder because of such rejections, nor shall the Bidders seek any recourse of any kind against the District because of such rejections. The filing of any Bid in response to this invitation shall constitute an agreement of the Bidder to these conditions.

The work to be performed generally includes, but may not be limited the following components: The District is seeking a Contractor to furnish and install landscaping around the new Hatcher Water Treatment Plant. The project includes all associated materials, equipment and appurtenances required for a completely functioning system and as identified in the Project Site meeting.

The requirements of the above scope of services will be discussed at a Project Site meeting to be held at 9:00 a.m. Monday July 18, 2011 at the new Hatcher Water Treatment Plant, 504A Hatcher Circle, Pagosa Springs, CO. OPPORTUNITY TO COMMENT

Turkey Springs Trail Management Plan

San Juan National Forest

Pagosa Ranger District

Archuleta County, Colorado

The Pagosa Ranger District is requesting comments on the Turkey Springs Trail Management Plan Environmental Assessment (EA). The analysis area is approximately 67,569 acres in size, with approximately 56,099 acres being on National Forest System lands. The analysis area is east of Pagosa Springs, Colorado, in portions of Township 34-36 North, Range 2-4 West, N.M.P.M.

The purpose of this project is to address recreation opportunities and existing problems relating to the network of system and non-system trails in the Turkey Springs, Middle Mountain, Horse Mountain, and Devil Mountain areas, including inadequate opportunities for some use types, fragmented trail systems, proliferation of user-created routes, and unwanted impacts to forest resources. The project seeks to establish a trail system that will enhance and improve recreation opportunities in a manner that is both socially and ecologically sustainable.

An open house devoted to the Turkey Springs Trail Management Plan will be held on Thursday, July 28th at the Pagosa Springs Community Center. The public may drop by any time between 4:30 and 7:30 p.m. to visit with Forest Service representatives, view maps, and obtain information on the project and planning process.

The pre-decisional EA for the Turkey Springs Trail Management Plan is now available for public review and comment. The EA can be downloaded from the San Juan National Forest projects web site at: www.fs.usda.gov/goto/sanjuan/projects

How to Comment and Timeframe

Written, facsimile, hand-delivered, oral, and electronic comments concerning this action will be accepted for 30 calendar days following the publication of the announcement of the Opportunity to Comment in the Durango Herald. The publication date in the Durango Herald is the exclusive means for calculating this comment period. Publication is anticipated for July 14, 2011.

To be eligible to appeal the subsequent decision on this project, an individual or group must provide comment or otherwise express interest in the proposed action during this comment period. Those individuals and organizations wishing to be eligible for appeal must provide the information as stated in 36 CFR 215.6 (3). Regulations prohibit extending the length of the comment period.

Electronic comments must be submitted in a format such as an email message, plain text (.txt), rich text format (.rtf), and Word (.doc) to comments-rocky-mountain-san-juan-pagosa@fs.fed.us. In cases where no identifiable name is attached to an electronic message, a verification of identity will be required for appeal eligibility. A scanned signature is one way to provide verification. For electronically mailed comments the sender should normally receive an automated acknowledgement from the agency as a confirmation of receipt. If the sender does not receive an automated acknowledgement receipt of comments, it is the senders responbility to insure timely receipt by other means (36 C.F.R. 215.6 (4) (iii)).

Comments received in response to this solicitation, including names and addresses of those who comment will be considered part of the public record on this proposed action and will be available for public inspection. Comments submitted anonymously will be accepted and considered; however, those who only submit anonymous comments will not have standing to appeal the subsequent decision under 36 CFR Part 215.14.

La Plata Electric Association is requesting an approval by the Board of County Commissioners for a Conditional Use Permit application to reconstruct and upgrade their existing Ponderosa electrical substation at an alternate site across Highway 160 from the existing site, to include a variance from the 40 foot height restriction to allow structural framework and lightning protection to be constructed to approximately 48 feet, and a variance from a detention pond requirement. The alternate site is located on a portion of the Parelli Property, 7110 Highway 160 which is approximately 3 miles west of Pagosa Springs town limits.
