FOR PLANNING COMMISSION HEARING ON MARCH 24, 2011

An O&G Conditional Use Permit on a portion of 465 acres is proposed in the SW portion of Section 15, Township 33N, Range 5W, N.M.P.M. The proposal is for a water collection facility using the originally permitted staging yard portion of the property (approximately 1.5 acres in size). There is no new gas production or compression activity associated with this application. The property is located at 11501 A-5, Highway 151, approximately 6 miles north of Arboles or 11.5 miles south of Highways 151 and 160.

Comments regarding this proposal may be submitted to the Archuleta County Planning Department, P.O. Box 1507, Pagosa Springs, CO 81147-1507, telephone: (970) 731-3877 prior to the public hearing by the Planning Commission on March 23, 2011 at 6:00 p.m. in the County Courthouse. NOTICE IS HEREBY GIVEN that the County of Archuleta requests for any contractor to perform work

for the County of Archuleta for no cost reimbursement for equipment and labor of the following:

1. Haul backfill and dirt into and out of the Archuleta County Fairgrounds.

2. Repair drainage and regrade Archuleta County Fairgrounds.

3. Create drainage for roadway leading through Archuleta County Fairgrounds complex.

4. Create/reinforce drainages around perimeter of the Archuleta County Fairgrounds.

5. Install Culvert at the Mill Creek Gate to Archuleta County Fairgrounds.

6. Level and grade off Parking Area on North end of Archuleta County Fairgrounds.

This work will extend from fiscal year 2011 and may be extended through 2012 unless terminated prior to in writing. In the event that no contractor is able to conduct the work by providing labor and equipment for no charge, the Colorado Army National Guard, Joint Force Headquarters – Colorado (COARNG), 947th Engineering Company, in cooperation with the County of Archuleta will commence operations to complete the extensive list of non-funded projects. This will commence in the Spring of 2011 and will terminate upon completion of this list of projects. Any additional non-funded projects that evolve will be published in the same manner.

Costs incurred by the District for the engineering, design and construction amounted to approximately $3.76 million. Costs incurred by the District for land acquisition associated with the enlargement of Stevens Reservoir totaled approximately $833,685 during the diligence period, (c) The District prosecuted applications in the water court for water rights related to other facilities that are a part of the District’s integrated municipal water system and has continued to protect its water rights by participating in water court adjudications of the water rights of others to prevent a negative impact on the water yields of the District’s water rights. The legal and engineering costs incurred by the District for these matters totaled approximately $114,475 during the diligence period, (d) The District has continued to update and modify its water planning efforts during the diligence period in accordance with the changing demands for water within the District. Engineering work commissioned and other costs associated with the implementation of water conservation programs, raw water irrigation systems and other master planning efforts amounted to over $410,000, (e) Expenditures by the District for necessary improvements, repairs and operations of raw water supply ditches during the diligence period have totaled approximately $25,550, (f) The District prosecuted its joint water rights application for the Dry Gulch Project, conducted preliminary investigations into environmental, cultural, land acquisition and design matters, and has engaged consultants to work toward further development of the project. Expenditures for these legal, engineering, consulting and related costs have totaled approximately $444,840, (g) The District provided funding for planning and acquisition of land related to the Dry Gulch Project. Expenditures for this acquisition totaled over $8.54 million, (h) The District expended over $430,000 toward design and installation of upgrades and improvements to the San Juan Water Treatment Plant; (6) Name and address of potentially affected landowners: To the best of Applicant’s knowledge and belief, the decreed locations of the San Juan Intake point of diversion, the San Juan Raw Water Storage Reservoir and the San Juan Recreation Reservoir are located on land owned by the Alpine Cascade Corporation, P.O. Box 4490, Pagosa Springs, Colorado 81157. Bids shall be presented in the form of a total Base Bid proposal under a Lump Sum Contract plus any additive or deductive alternates that are selected by the Owner. NOTE: Base Bid price shall not include state gross receipts or local options taxes. Taxes will be included in the Contracted Amount at prevailing rates as a separate item to be paid by Owner.

In submitting this bid, each Bidder must satisfy all terms and conditions of the Bidding Documents.

All work covered by this Invitation to Bid shall be in accordance with applicable state laws and, if bid amount is $60,000 or more, is subject to the minimum wage rate determination issued by the office of the Labor Commissioner for this project. If the bid amount of the contractor or any subcontractor exceeds $50,000, the contractor and/or subcontractor must comply with the registration requirements pursuant to the Public Works Minimum Wage Act.

Bid Security, if bid greater than $25,000, in the form of a surety bond executed by a surety company authorized to do business in the State of New Mexico in the amount of 5% of the total bid, or the equivalent in cash by means of a cashier’s check or in a form satisfactory to the Owner, must accompany each bid in accordance with the Instructions to Bidders.

A 100% Performance Bond and a 100% Payment and Materials Bond executed by a surety company authorized to do business in the State of New Mexico shall be required from the successful Bidder prior to award of contract.

A completed Subcontractor Listing Form must accompany each bid.

Each subcontractor shall provide a performance and payment bond on a public works building project if the subcontractor’s contract (to the Contractor) for work to be performed on a project is one hundred twenty-five thousand dollars ($125,000) or more. Failure of a Subcontractor to provide required bond shall not subject the Owner to any increase in cost due to approved substitution of Subcontractor.

The Bidding Documents contain a time for completion of the work and further impose liquidated damages for failure to complete the work within that time period.

No Bidder may withdraw his bid for 45 days after the actual date of the opening thereof.

The Owner intends to award this Project to the lowest responsible Bidder. The Owner reserves the right to reject any and all bids, to waive technical irregularities, and to award the contract to the Bidder whose bid it deems to be in the best interest of the Owner.

Attention of the Bidder is particularly directed to the current requirements as to Resident Contractor’s Preference per Section 13-4-3 NMSA 1978. The provisions of Sections 13-4-1 through 13-4-4 NMSA 1978 are not applicable to projects receiving Federal aid or when the expenditure of Federal funds designated for a specific contract is involved.
