NOTICE OF APPLICATION BY THE ARCHULETA COUNTY 911 AUTHORITY TO INCREASE THE 911 EMERGENCY TELEPHONE SURCHARGE FEE

NOTICE IS HEREBY GIVEN that the Archuleta County 911 Authority Board (the “Authority”) has applied to the Colorado Public Utilities Commission (the “Commission”) for approval to increase emergency telephone surcharge fees effective January 1, 2011. The Commission Docket number for this proceeding is 10A-449T .

The increase will be from the current amount of Seventy ($0.70) to One Dollar and Twenty-Five Cents ($1.25) per user per wired, wireless, or VoIP telephone user. The total amount to be raised by the surcharge in 2011 is estimated to be Two Hundred and Thirty Two Thousand Dollars ($232,000) with $100,000 estimated to be attributable to the surcharge increase. This increase is necessary to partially finance: (1) the relocation of the sole Public Safety Answering Point in Archuleta County to secure a reliable facility; (2) the replacement of the current 911 system with a reliable, next generation capable system; (3) the upgrade of existing Computer Aided Dispatch and Radio Console equipment to reliable systems. As the increase is estimated to only cover a portion of the above listed expenses, the Authority anticipates that additional funding will come from Archuleta County and other involved entities.

All residents with a wired, wireless, or VoIP phone will be affected by this increase. The applications filed by the Authority with the Commission is available for public inspection at the administration offices of Archuleta County at 449 San Juan Street, Pagosa Springs, Colorado 81147 and at the Colorado Public Utilities Commission at 1560 Broadway, Suite 250, Denver, Colorado 80202.

Any person may file written comments or objections concerning the applications with the Commission at the offices of the Colorado Public Utilities Commission at 1560 Broadway, Suite 250, Denver, Colorado 80202 or by E-mail to PUC@DORA.state.co.us. The Commission will consider all written comments and objections prior to the evidentiary hearing on this application.

Any person desiring to intervene in or participate as a party in this proceeding shall file a petition for leave to intervene, or under the Commission’s Rules of Practice and Procedure, file other appropriate pleadings to become a party, within 30 days after the date of this Notice.

All persons who file an objection, notice of intervention as of right, motion to permissively intervene, or any other appropriate pleasing shall do so in accordance with the instructions set forth in the Commission’s Rules of Practice and Procedure.

The Commission may hold a public hearing in addition to an evidentiary hearing on this application and if such hearing is held, members of the public may attend and make statements even if they did not file comments, objections, or an intervention. If this application is unopposed or uncontested, the Commission may determine this matter without hearing and without further notice.
