Invitation for Bid

Construction of a Skate Park

In Pagosa Springs, Colorado

Notice is hereby given that Archuleta County, acting in conjunction with the Town of Pagosa Springs, will accept sealed bids for the construction of a Skate Park in 2011.

FIVE SETS (ONE UNBOUND PRINTED ORIGINAL, THREE PRINTED COPIES AND ONE ELECTRONIC COPY ON A CD), clearly marked “Construction of Skate Park for Pagosa Springs” and the name, address and phone number of the bidder will be received by Larry Walton, Contracts & Procurement Office, 449 San Juan Street, P.O. Box 1507, Pagosa Springs, Colorado (970) 264-8555, until 2:00 p.m., August 5th, 2010. As soon as practical after closing time the bids shall be opened in public and read aloud at the Archuleta County Courthouse. Bids received after the closing time shall be returned unopened to the bidder. A bid tab shall be forwarded to all Bidders as soon as practicable thereafter.

Bid terms and documents, including the Skate Park technical specifications and drawings, and a Geotechnical Evaluation of the site are available from the Contracts & Procurement Officer, at the address above. Questions concerning this bid should be submitted in writing to Larry Walton, lwalton@archuletacounty.org. Answers to all questions, inquiries, or requests for additional information will be issued in the form of Addenda. Archuleta County will not be responsible for the authenticity or correctness of oral interpretations of the contract documents or for information obtained in any other manner than through the media of Addenda. Bidders in their bids shall acknowledge receipt of each Addendum, and each Addendum shall be considered a part of the contract documents. Failure to acknowledge receipt of an Addendum issued may invalidate a bid as incomplete. Questions must be received no later than 4:00 p.m. July 29, 2010.

The bid shall be awarded by the Pagosa Springs Town Council contingent on receipt of grant funding supporting project costs. It is the Bidders’ responsibility to verify the exact date of the award. Bidders may, but shall not be required to, attend the award of bid. Notice to Proceed with construction of the Skate Park will be issued as soon as weather conditions permit, in the spring of 2011.

The Town of Pagosa Springs reserves the right to reject any and all bids, to waive any informalities and minor irregularities in bids, and to accept the bid deemed, in the opinion of the Town, to be in the best interest of the residents of Pagosa Springs and Archuleta County.

Notice for Publication

La Plata Electric Association is requesting a variance from section 3.1.4. of the Archuleta County Land Use Regulations for a 7’10” height variance to construct a lightning rod and ionizer at 47’10” total. This is 6’5” higher than the existing substation equipment. The property is approximately 3.12 acres located in the NE quarter of Section 36, Township 35N, Range 2 1/2 W, N.M.P.M in Archuleta County. The address is 7341 W State Hwy 160 which is approximately 2.9 miles west of Pagosa Springs town limits.

NOTICE OF INTENT OF A CONTINUOUS PROGRAM TO MODIFY WEATHER

Notice is hereby given that Western Weather Consultants L.L.C., P.O. BOX 58, Durango, CO 81302 hereinafter referred to as WWC has filed with the Colorado Water Conservation Board an application for renewal of WWC’s ten-year permit to conduct a wintertime ground-based weather modification program within the State of Colorado in the Eastern San Juan Mountains for the following local entities:

Southwestern Water Conservation District, San Juan Water Conservancy District, Pagosa Area Water & Sanitation District, Pine River Irrigation District, City of Durango, and the Florida Water Conservancy District

Since 2007, in support of cooperative agreements among the States in the Colorado River Basin, the New Mexico Interstate Stream Commission, California Six Agency Committee, Southern Nevada Water Authority, Central Arizona Water Conservation District, and the Colorado Water Conservation Board granted additional funding to support this program.

Larry Hjermstad, Manager of Western Weather Consultants, Mike Hjermstad, Asst. Manager and Head of Operations for Western Weather Consultants, and Eric Hjermstad, Head of Field Operations for Western Weather Consultants shall be in control of the program, and Western Weather Consultants is the Permit Holder.

The Primary Target Area for the ten-year Weather Modification Permit is defined as follows: the Eastern San Juan Mountains including the mountain ranges that drain into the Florida River, Pine River, Piedra River, San Juan River, Navajo River and the Blanco River. The goal is to increase snowpack snow water content in the Primary Target Area to benefit: natural habitat, agriculture, municipal water, stock growers, recreational interests, and the local economy.

The Colorado Revised Statutes (Title 20, 36-20-101 through 36-20-126) do not require notice for permit renewals but the applicant was requested to publish notice of intent in the target area and adjacent counties. These counties include: Montezuma, Dolores, San Miguel, Ouray, San Juan, La Plata, Hinsdale, Mineral, Archuleta, Rio Grande, Conejos, Saguache, and Gunnison.

The program shall be continuous from November 1 through – March 31, 2011 for each year for the next ten years, expiring on 2020. Operations will be limited for safety reasons so that there will be monitoring for severe conditions, avalanche danger and snowpack thresholds, and annual notification to emergency managers, among other requirements. The Permit Holder is requested to coordinate regularly with the CWCB to ensure operations are operated judiciously to minimize danger to land, health, safety, people, property and the environment on behalf of the citizens as directed by the Colorado Revised Statutes.

LEGAL DESCRIPTION

The land referred to in this policy located in the State of Colorado, County of Archuleta is described as follows:

Tract I:

A tract of land lying and being in the South One-Half South One-Half Southwest One-Quarter and the South One-Half Southwest One-Quarter Southeast One-Quarter of Section 20, Township 35 North, Range 2 West, N.M.P.M., being more particularly described as follows, to-wit:

BEGINNING at a point on the South boundary line of said Section 20 whence the Southeast corner of said Section 20 bears South 89° 27’ 47” East, 1882.23 feet, said point of beginning also being the Southwest corner of tract described in Deed from Fairfield Pagosa, Inc., to Grant General Contractors, Inc., recorded May 29, 1992 in Book 372 Page 248;

Thence North 89° 26’ 14” West. 1963.79 feet along the South boundary line of said Section 20 to a 1” rebar with P.S. 26228 cap set at a point on the Easterly right-of-way line of Meadows Drive;

Thence along said Easterly right-of-way line North 00° 04’ 12” East, 0.67 feet;

Thence 205.98 feet along a curve to the left having a delta of 33° 46’ 01”, radius of 349.51 feet and a chord bearing of North 16° 48’ 49” West, 203.01 feet along said right-of-way line;

Thence North 33° 41’ 50” West, 161.31 feet along said right-of-way line to the South boundary line of tract described in Deed from Fairfield-Eaton, Inc., to the Colorado District of the Lutheran Church-Missouri Synod recorded July 28, 1983 in Book 200 Page 768;

Thence North 89° 37’ 51” East, along said South boundary line 438.59 feet to the Southeast corner of tract described in said Book 200 Page 768;

Thence North 00° 21’ 18” West, 290.89 feet along the East boundary of tract described in said Book 200 Page 768;

Thence North 89° 36’ 50” East, 1685.73 feet to the West boundary line of tract described in said Book 372 Page 248;

Thence South 00° 55’ 33” West, 653.65 feet along said West boundary line to the point of beginning.

Tract II:

A parcel of land being and comprising a portion of the South One Half of Section (20), Township Thirty-five (35) North, Range Two (2) West, N.M.P.M., within Archuleta County, Colorado, being more particularly described by metes and bounds field survey as follows:

BEGINNING at a point on the Southerly boundary of the herein described tract of land, from whence the Southeast corner of the above Section Twenty (20) bears South 78° 55’ E, 3153.78 feet distance, and running thence from said point of beginning: South 88° 36’ West, 472.21 feet to the Southwest corner of the herein described tract of land and running thence, North 01° 24’ West, 338.43 feet to the Northwest corner of the herein described tract of land, and a point on the Southerly Right-of-Way line of U.S. Highway No. 160, and running thence; along said right-of-way; North 55° 17’ East, 208.72 feet to a point thence leaving said right-of-way line and running thence South 34° 43’ East, 208.72 feet to a point, and running thence North 55° 17’ East, 365.26 feet to a point, and running thence; North 34° 43’ West, 208.72 feet to a point on the Southerly right-of-way line of U.S. highway No. 160, and running thence along the said right-of-way line; North 55° 17’ East, 52.18 feet to a point, thence leaving said right-of-way, and running thence; South 34° 43’ East, 417.44 feet to a point, and running thence; North 55° 17’ East, 417.44 feet to the Northeast corner of the herein described tract of land and running thence; South 34° 43’ East, 674.15 feet to the Southeast corner of the herein described tract of land and running thence; South 88° 36’ West, 999.34 feet to the point of beginning.

Less and except the following:

Commencing at a found 1/2” iron rod with a plastic cap being the Northwest corner of lot 57 of Pagosa Meadows Subdivision, run thence North 0° 03’ 29” East for a distance of 0.67 feet along the easterly right-of-way line of Meadows Drive to a point; run thence around a curve to the left having a radius of 349.59 feet, a central angle of 33° 46’ 01”, a chord bearing of North 16° 49’ 33” West and a chord length of 203.06 feet for a distance of 206.03 feet to a point, run thence North 33° 42’ 33” West for a distance of 71.57 feet to a set 5/8” iron rod with a 2” aluminum cap bearing the inscription “Lloyd P. Short P.L.S.. 33675” being the point of beginning. From the point of beginning, continue North 33° 42’ 33” West for a distance of 89.77 feet to a point that is monumented by a witness corner that bears North 89° 37’ 51” East at a distance of 20.00 feet; run thence North 89° 37’ 51” East for a distance of 438.59 feet to a found 1/2” iron rod with no cap, this course being the basis of bearings for this survey; run thence North 00° 22’ 00” West for a distance of 290.99 feet to a set 5/8” iron rod with a 2” aluminum cap bearing the inscription “Lloyd P. Short P.L.S.. 33675”; run thence North 89° 35’ 47” East for a distance of 188.38 feet to a set 5/8” iron rod with a 2” aluminum cap bearing the inscription “Lloyd P. Short P.L.S.. 33675”; run thence South 00° 32’ 00” East for a distance of 366.10 feet to a set 5/8” iron rod with a 2” aluminum cap bearing the inscription “Lloyd P. Short P.L.S.. 33675”; run thence South 89° 37’ 51” West for a distance of 577.63 feet to the point of beginning. Parcel containing 100,000 square feet or 2.296 acres.

NOTICE OF SALE

The current holder of the Evidence of Debt secured by the Deed of Trust, described herein, has filed Notice of Election and Demand for sale as provided by law and in said Deed of Trust.

THEREFORE, Notice Is Hereby Given that I will at public auction, at 10:00 A.M. on Thursday, 07/22/2010 the date to which the sale has been continued pursuant to C.R.S. 38-38-103(2)(a), at 449 San Juan St., Pagosa Springs, CO 81147, sell to the highest and best bidder for cash, the said real property and all interest of the said Grantor(s), Grantor(s)’ heirs and assigns therein, for the purpose of paying the indebtedness provided in said Evidence of Debt secured by the Deed of Trust, plus attorneys’ fees, the expenses of sale and other items allowed by law, and will issue to the purchaser a Certificate of Purchase, all as provided by law.
