This is to advise you that the above-captioned action is pending. A Judgment and Decree for Judicial Foreclosure has been entered in this action concerning an assessment lien by the plaintiff Eagle’s Loft Property Owners Association, Inc. pursuant to the Colorado Common Interest Ownership Act, Colorado Revised Statutes, §3-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Eagle’s Loft Property Owners Association, Inc. of (said) Assessment Lien being recorded on September 8, 2009 at Reception No. 20906868, in the office of the Clerk and Recorders Office of Archuleta County, Colorado (the “Assessment Lien”).

The San Juan Basin Area Agency on Aging (AAA), a 501(c)(3), is soliciting proposals for a State-required single audit, based on federal guidelines from independent Certified Public Accounting firms. The agency provides services for older adults (60+) within Region 9 of the state of Colorado, including Archuleta, San Juan, La Plata, Montezuma and Dolores counties. Audits shall be conducted in accordance with Federal requirements for non-profit organizations and as directed by the State Unit on Aging.

Stock includes approximately 30-40 yearling heifers per year, approximately 40 head of sheep and five horses. Stock also includes, until 2008, up to 20 chickens. B. Applicant and farm laborers used water from Gomez Reservoir to fill three small undecreed ponds in front of the house on the Applicant’s property in 2007, 2008 and 2009, as additional water for stock in several fenced pastures. C. Applicant and farm laborers, as part of the pasture rotation for the yearling heifers, watered them directly out of Gomez Reservoir every year for the entire diligence period. D. Reservoir water scooped up for almost entire day by U.S. Forest Service helicopters in 2008 to fight a fire on the mesa on the east side of Applicant’s ranch, caused by a lightning strike. The USFS never replaced the diverted water, as promised. E. Applicant’s son, Frank O. Gomez, Jr., and a contract laborer, in about 2007, repaired the valve turnout and pipeline out of Gomez Reservoir to clean it of sand and other debris. F. Applicant, during the spring, summer and fall months, monitors the Reservoir daily. In 2009, Applicant paid special attention to a wet area on the face of the dam, but the monitoring proved this not to be a major problem. G. With the assistance of Applicant’s son, Sylvester Gomez, Applicant improved the banks of Gomez Middle Pond. H. With the assistance of Joseph Lujan, Applicant planned for an irrigation system for the upper alfalfa area, but the pump purchased for the irrigation was stolen. I. With Applicant’s son, Frank, Applicant is planning to grow potatoes this year in a quarter acre field, to be watered from Gomez Reservoir. J. Gomez Reservoir has been used for recreation during the past six years, including swimming, camping and wildlife watching. K. The O’Bannon Ditch is also the filling structure for the Turkey Creek Ranch Reservoir Nos. 1 and 2 (“Reservoirs”), which were adjudicated by decree entered in Case No. 88CW16, by the District Court in and for Water Division No. 7, dated December 9, 1988. 5. Claim to Make Absolute: A. Applicant claims 5.0 cfs absolute for recreation, piscatorial, livestock watering and augmentation uses. The basis for this claim is as follows: the ranch manager reports year-round diversions at the O’Bannon Ditch that are often in the range of 6 – 10 cfs. At times the diversions include the Senior O’Bannon Ditch Right and at times diversions include HCU credits under the augmentation plan decreed in Case No. 03CW33. All other diversions may be credited, in part or in their entirety, to the conditional water rights decreed to the O’Bannon Ditch in Case No. 89CW95. Said diversions are applied to recreation, piscatorial, livestock watering and/or augmentation uses in conjunction with the Reservoirs, the trout channel that returns water from the Reservoirs to the San Juan River, and/or the O’Bannon Ditch. Attached as Exhibit A is a map depicting the location of the structures. B. 3.55 cfs for irrigation. The basis for this claim is as follows: The ranch manager reports a maximum of 6 cfs has been delivered down the O’Bannon Ditch for irrigation, of which 2.45 cfs is applied to the Senior O’Bannon Ditch Right. This leaves up to 3.55 cfs for irrigation under the more junior O’Bannon Ditch water right decreed in Case No. 89CW95. Attached is a map depicting the location of lands irrigated under the O’Bannon Ditch. 6. Detailed outline of work done toward completion of the appropriation and application of water to a beneficial use: Over the past six years, Applicant and its predecessor have invested roughly $200,000 in various water facilities and operations including, but not limited to, construction of ditch improvements, construction of an enlarged and improved O’Bannon Ditch headgate, dam improvements, ditch cleaning, fish stocking, installation of aerators, installation of flumes and pipelines, improvements to the trout channel, river riparian work, hiring of a ranch manager to operate the water facilities, and completion of the San Juan River Ranch augmentation plan. Applicant’s various water rights and related infrastructure are part of an integrated water supply system for the development of the San Juan River Ranch, and the O’Bannon Ditch is an integral part of that system. 7. Names and Addresses of owners of land upon which any new diversion or storage structure, or modified existing diversion or storage structure, is or will be located. Although the O’Bannon Ditch is neither a new or modified structure, it is noted that all structures referenced herein are located on land owned by Applicant, except for the existing headgate and a portion of the O’Bannon Ditch is located on land owned by Ken Zeiler, P.O. Box 2466, Pagosa Springs, CO 81147. No dirt to be removed by truck but dredge material to be used for an island. August and Sons contract to complete work at the cost of $21,200. During the winter of 2006-2007 site judged by Roger August to be too muddy and wet to perform the work required. Work postponed. Due to vandalism the outlet gate from Kruger reservoir was removed to be repaired. Cost paid to August and Sons: $10.600; (C) NRRPOA demanded some of the following requirements for the use of the NRRPOA’s roads for equipment to the Reservoir: Submit plans for the work; obtain a $50,000 Performance Bond from contractor; and submit a Liquidated Damages fee of $8,000.00 to be held in escrow. Applicant spent approximately $2,000 on lawyer fees to negotiate terms and conditions of road use; (D) Fall 2007 - August and sons prepared to start work, supplies purchased, outlet gate repaired and ready to install. Applicant received additional requirements from NRRPOA and spent approximately $2,000 on lawyer fees on the issue. Applicant denied access to site by NRRPOA; (E) Applicant filed and prosecuted court action in Case 08CV268 to confirm an easement for the Reservoir at a cost of over $20,000; (F) Applicant visited the Reservoir site with engineering and legal consultants and reviewed sites to which water rights could be changed. The State Engineer is establishing a Produced Nontributary Ground Water Notification List for each Water Division within the State of Colorado for the purposes of ensuring that water users within each Water Division receive adequate notice of petitions for determinations of nontributary groundwater submitted to the State Engineer pursuant to the Produced Nontributary Ground Water Rules.

Pursuant to the Produced Nontributary Ground Water Rules, persons or entities engaged in the mining of minerals may petition the State Engineer for a determination that water withdrawn to facilitate or permit the mining of minerals from wells in one or more geologic formations within a geographically delineated area is nontributary. Any person may respond to such a petition by submitting written comments or by requesting a hearing on the petition. Persons on the Produced Nontributary Ground Water Notification List shall be provided direct notice by either first-class mail or by electronic mail when petitions for determination of nontributary groundwater are submitted to the State Engineer. INVITATION TO BID

Separate sealed BIDS for the 2010 Resurfacing of Aspenglow Blvd., Handicap Ave., and Carlee Place will be received by Archuleta County at the Archuleta County Courthouse, Commissioner’s Room located at 449 San Juan Street, P.O. Box 1507, Pagosa Springs, Colorado, until 2:00 P.M. local time on APRIL 29, 2010, and then at said office publicly opened and read aloud.

The base project consists of reconstructing Aspenglow Boulevard from Piedra Road to Nocturn Drive and Handicap Avenue from Piedra Road to Pines Club Place. A potential addition the to project includes Pines Club Place from Handicap Avenue to Carlee Place and Carlee Place from Pinion Causeway to Park Avenue. The project includes: traffic control, milling the existing asphalt, excavating and reconstructing unstable sections of road, installing culverts, shaping ditches, placing geo-textile fabric, placing aggregate base course, and hot bituminous paving. The base project is approximately 1.7 miles in length, with the potential addition being nearly 0.3 miles long, for an overall possible total of 2.0 miles.

TO WHOM IT MAY CONCERN:

This is to advise you that the above-captioned action is pending. A Judgment and Decree for Judicial Foreclosure has been entered in this action concerning an assessment lien by the plaintiff Eagle’s Loft Property Owners Association, Inc. pursuant to the Colorado Common Interest Ownership Act, Colorado Revised Statutes, §3-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Eagle’s Loft Property Owners Association, Inc. of (said) Assessment Lien being recorded on September 8, 2009 at Reception No. 20906874, in the office of the Clerk and Recorders Office of Archuleta County, Colorado (the “Assessment Lien”).

The real property which is the subject matter of this litigation, which is the property subject to the Assessment Lien, is situation in Archuleta County, and is described as follows, to-wit:

Unit Number 47 Building Number 47, Unit Week Number 19, in “EAGLE’S LOFT – Phase IV, as Reception No. 137941 and in accordance with and as limited and defined by the Declaration of Individual and/or Interval Ownership, recorded under Reception Number 117700 in Book 200 at Page 834 et seq and amendments and supplements thereto in the Office of the County Clerk and Recorder in and for Archuleta County, Colorado.

The Plaintiff named above is the judgment creditor in this action and the lienor of the property pursuant to the Colorado Common Interest Ownership Act, Colorado revised Statutes, §33-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Eagles’ Loft Property Owners Association. As of February 1, 2010, the outstanding balance due and owing on such judgment is $2,769.12.

I shall offer for public sale to the highest bidder, for case, at public auction, all the right, title and interest of the defendants in said property on June 30th, 2010 at 10:00 a.m. at the Archuleta County Sheriff’s Office, 449 San Juan St., Pagosa Springs, CO 81147.
