ADVERTISEMENT TO BID

Bids will be received by the Pagosa Area Water & Sanitation District (PAWSD) at 100 Lyn Ave, PO Drawer 4610, Pagosa Springs, CO 81157, until 2:00 p.m. on December 18, 2009. Bids received after this time will not be accepted.

At 2:00 p.m. on December 18, 2009, the bid opening shall be held at the PAWSD Conference Room at 100 Lyn Avenue, Pagosa Springs, Colorado. All Bids that have been duly received will be opened publicly and read aloud. All interested parties are invited to attend. The Owner reserves the right to reject any or all Bids and to waive irregularities or informalities in any bid, and all Bidders shall agree that such rejection shall be without liability on the part of the Owner for any damage or claim brought by any Bidder because of such rejection, nor shall the Bidders seek any recourse of any kind against the Owner because of such rejections. No bid may be withdrawn within a period of 60 days. The filing of any Bid in response to this invitation shall constitute an agreement of the Bidder to these conditions.

Bids will be received on a lump sum basis with schedule of sections, additive alternates, and deductive alternates. The Work generally includes the following components:

Vista WWTP: The project will consist of the installation of a new centrifuge and the re-installation of an existing centrifuge within an existing solids handling building at the existing Vista wastewater treatment facility and the investigation of an end product biosolids facility that will be addressed as an allowance. The project will include the installation of a new centrifuge, an existing centrifuge, a redundant polymer feed system necessary for the centrifuge equipment, the replacement of new control panel(s) and removal of the existing control panel, process piping, valves, and fittings for the digested sludge to the centrifuges, provision of a spare digested sludge pump, seal water piping to the existing digested sludge pump, and the new odor control system, improvements to the existing site access road, and all associated materials, equipment, and appurtenances required for a completely functioning system as identified in the Contract Documents. The Work shall be completed and ready for final payment within 180 calendar days. The end product biosolids facility allowance will include the costs associated with pilot study facilities, to include but not be limited to indirect thermal drying system pilot unit, integral odor control system, temporary enclosing structure, conveyance of enclosing structure air handling to the newly constructed centrifuge odor control system, and the construction of a biosolids facility if the PAWSD determines that such as facility is a beneficial and cost effective solution for the facility solids handling system.

Bids shall include Bid security in the form of a certified or bank cashier’s check or a Bid Bond in the amount of 5% of total Bid price. The Bidder to whom a Contract is awarded will be required to furnish Performance, Payment and Warranty Bonds.

This is to advise you that the above-captioned action is pending. A Judgment and Decree for Judicial Foreclosure has been entered in this action concerning an assessment lien by the plaintiff Mountain Meadows Property Owners Association, Inc. pursuant to the Colorado Common Interest Ownership Act, Colorado Revised Statutes, §3-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Mountain Meadows Property Owners Association, Inc. of (said) Assessment Lien being recorded on April 2, 2009 at Reception No. 20902296, in the office of the Clerk and Recorders Office of Archuleta County, Colorado (the “Assessment Lien”).

Together with a right of ingress and egress over the existing road to Lakeside Drive.

The Plaintiff named above is the judgment creditor in this action and the lienor of the property pursuant to the Colorado Common Interest Ownership Act, Colorado revised Statutes, §33-33.3-316(2)(a), and the Plaintiff’s Property Owners Association Declaration for Mountain Meadows Property Owners Association. As of October 1, 2009, the outstanding balance due and owing on such judgment is $2,418.00.

I shall offer for public sale to the highest bidder, for case, at public auction, all the right, title and interest of the defendants in said property on 01/20, 2010 at 10:00 a.m. at the Archuleta County Sheriff’s Office, 449 San Juan St., Pagosa Springs, CO 81147.
